Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Rock & Roll: Pet Rock or any other application (each an "App") operated by Three Gingers Holdings LLC ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.

For users under 13: A parent or legal guardian must review and agree to these Terms on behalf of the minor. Use of the App by a minor without parental consent is prohibited.

2. Eligibility

• You must be at least 4 years old to use the App
• Users under 13 require verifiable parental consent
• You must have the legal capacity to enter into these Terms in your jurisdiction

3. Account Registration

• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activity under your account
• You may not create accounts for others without their (or a parent's) consent
• We reserve the right to suspend or terminate accounts that violate these Terms

4. In-App Purchases

• The App is free to download and offers optional in-app purchases ("IAP")
• All IAP transactions are processed by Apple's App Store or Google Play, subject to their terms
• In-app purchases are non-refundable except as required by applicable law or as approved by Apple/Google refund policies
• Prices are subject to change with notice
• Battle Pass subscriptions auto-renew unless canceled through your device settings before the renewal date
• Parental Controls: We strongly encourage parents to use Apple's "Ask to Buy" or Google's Family Link features to require approval for all in-app purchases by minors

5. Virtual Items and Currency

• In-game currency (Pebbles, Boulders, Geodes), decorations, rocks, and other virtual items have no real-world monetary value
• Virtual items and currency are licensed to you, not sold; you do not own them
• Virtual items cannot be exchanged for real money or transferred outside the App
• We reserve the right to modify, suspend, or discontinue virtual items or currency at any time
• Trades and gifts between users are final and cannot be reversed except in cases of fraud or abuse

6. User Conduct

You agree NOT to:

• Use the App for any unlawful purpose
• Impersonate any person or misrepresent your identity
• Harass, bully, threaten, or discriminate against other users
• Use offensive language, imagery, or usernames
• Attempt to hack, reverse-engineer, or exploit the App
• Use bots, scripts, or automation to gain unfair advantage
• Buy, sell, or transfer accounts
• Use the App to violate the intellectual property rights of others
• Share personal information about yourself or others (especially minors) publicly

Violations may result in account suspension, termination, and forfeiture of virtual items and currency without refund.

7. Communication Between Users

• The App includes limited social features (friend adds, trades, competitions)
• Chat is limited to pre-selected phrases and emojis by default
• Free-form chat is available only between confirmed friends and is disabled for users under 13 unless parental consent has been granted
• We monitor for abusive content and reserve the right to remove content or suspend users

8. Intellectual Property

• The App, including all rocks, decorations, artwork, music, code, and content, is owned by Three Gingers Holdings LLC or its licensors
• You are granted a limited, revocable, non-transferable license to use the App for personal, non-commercial purposes
• You may not copy, distribute, modify, or create derivative works from the App or its content

9. User-Generated Content

If the App allows you to create custom rock designs or content:

• You retain ownership of your original creations
• You grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content within the App
• You represent that you own or have rights to any content you create
• We may remove content that violates these Terms

10. Service Availability

• We strive for high availability but do not guarantee uninterrupted service
• We may perform maintenance, updates, or modifications at any time
• We reserve the right to discontinue the App or specific features with reasonable notice
• In the event of discontinuation, refunds for unused subscription time will be provided as required by applicable law

11. Disclaimers

• THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND
• WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR PURPOSE, AND NON-INFRINGEMENT
• We do not warrant that the App will be error-free, secure, or continuously available

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• OUR LIABILITY IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) $100 USD
• WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• SOME JURISDICTIONS DO NOT ALLOW THESE LIMITATIONS, IN WHICH CASE THEY APPLY TO THE MAXIMUM EXTENT PERMITTED

13. Indemnification

You agree to indemnify and hold harmless Three Gingers Holdings LLC, its officers, employees, and agents from any claims arising from your use of the App, violation of these Terms, or infringement of any third party's rights.

14. Termination

• You may stop using the App at any time
• We may suspend or terminate your access for violation of these Terms
• Upon termination, your right to use the App ends immediately; virtual items and currency are forfeited without refund

15. Governing Law and Disputes

• These Terms are governed by the laws of the State of Texas, USA, without regard to conflict of law principles
• Any disputes will be resolved in the state or federal courts located in Collin County, Texas
• For users under 13: A parent or guardian's agreement to these Terms includes agreement to this dispute resolution provision

16. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated in the App or via email. Continued use of the App after changes constitutes acceptance.

17. Severability

If any provision of these Terms is held invalid, the remaining provisions remain in effect.
